It broke within two years: what does the law give me, and is an extended warranty or phone insurance worth it?
The TV broke at 18 months and the shop says “the warranty has expired”. What the 2-year legal guarantee is, the 25 days for a repair, when you are owed a price reduction or a refund, and what an extended warranty or phone insurance adds (or does not). Information only.

In short
The law already gives you a two-year legal guarantee from delivery, against the seller, without paying anything extra. An extended warranty overlaps with the first two years you already have; check what it adds before you pay.
- Keep purchase receipts, with the delivery date, in a folder or as photos.
- If it breaks, notify the seller in writing within two months of noticing the defect.
- Before an extended warranty or insurance, ask in writing who issues it, what it adds and the exclusions.
- For defects, the competent body is the Consumer Protection Service.

At a glance
- The law already gives you a 2-year legal guarantee from delivery, against the seller, without paying anything extra (Law 154(I)/2021, for contracts from 1 January 2022).
- Notify the seller within two months of noticing the defect. Repair or replacement is free, within 25 days at most in Cyprus.
- If that does not happen, you are owed a price reduction or termination with a refund (according to a law firm’s summary of the law).
- An extended warranty bought in the shop overlaps with the first two years you already have; it may add accidental damage or years after the second. Check before you pay.
- For defects, the competent body is the Consumer Protection Service; for an insurer’s refusal, the Financial Ombudsman.
“The warranty has expired” is not always the last word
You paid a lot for a phone, a washing machine, a TV. It breaks, and you hear that the “one-year warranty” is over, or that you must wait two months for the manufacturer. At the till you were also offered an extended warranty or insurance, and you wonder whether you should have taken it. Let us separate three different things: the legal guarantee the law gives you, the commercial warranty of the manufacturer or shop, and insurance.
| What it is | Who answers | |
|---|---|---|
| Legal guarantee | Two years from delivery, free repair or replacement, then a price reduction or refund. You pay nothing extra. | The seller (the shop) |
| Commercial warranty | A promise by the manufacturer or shop, on its own terms. It does not take away the legal guarantee. | Whoever gives it |
| Extended warranty / insurance | You pay extra. It may cover accidental damage, theft or years after the second, with exclusions and an excess. It may be insurance or just a promise by the shop. | The insurer or the provider |
The legal guarantee step by step
- A defect within two years of delivery. For purchases with a contract from 1 January 2022. It does not cover damage you caused, such as a drop.
- Notify the seller within two months. From when you noticed the defect. In writing, with proof of purchase, and keep a copy.
- Free repair or replacement, up to 25 days. The 25-day maximum applies in Cyprus (according to the summary of the law).
- Otherwise, a price reduction or a refund. If repair or replacement is not done properly or in time, you can ask for a price reduction or termination with a refund.
Extended warranties and phone insurance: what to ask
The European insurance supervisor (EIOPA) notes that products sold alongside others, such as through telecom or energy companies, often have low claims ratios, high commissions, automatic renewals and exclusions that narrow cover, and it singles out gadget insurance (EU data from 2025, not Cyprus). That does not mean every such product is useless; it means it is worth knowing what you buy. Before paying, ask in writing who issues the cover, whether it is insurance, what it adds beyond the law’s two years, what it excludes (loss, “unattended”, liquids), the excess, and how it is cancelled.
For phone insurance and other add-ons that did not pay, and how to stop them, see Phone insurance, warranties and other add-ons; for sales that look suspicious, Is it a scam? How to check who you are dealing with.
What went wrong for others — and how to avoid it
- A “small” cover renewed automatically for years without being used (EU, not Cyprus). Once a year, check card statements and bills for cover you do not need, and stop it in writing before renewal.
- A gadget claim was refused under an exclusion the customer had not read, such as “unattended” or loss (EU, not Cyprus). Before buying, ask for the full terms, not just the leaflet, and read the definitions of theft and loss.
Your questions, one by one
Is it worth buying the extended warranty the electronics shop offers?
For the first two years you already have the legal guarantee against the seller, at no cost. An extension is worth it only for what it adds beyond that, for example accidental damage or year three onwards. Ask in writing what exactly it covers, who issues it and the exclusions, and compare with the cost of a possible repair.
How long is the legal guarantee on electronics in Cyprus without paying extra?
Two years from delivery, against the seller, at no extra cost (Law 154(I)/2021, for contracts from 1 January 2022, according to a law firm’s summary). Notify the seller within two months of noticing the defect.
The shop says my one-year warranty is over, but the TV broke after 18 months. Do I have rights?
Yes, very probably. The one-year commercial warranty does not take away the 2-year legal guarantee against the seller, if the defect is not damage you caused. Ask in writing for a free repair or replacement under Law 154(I)/2021, within two months of noticing it. If they refuse, turn to the Consumer Protection Service.
Is a cracked phone screen covered by home contents insurance?
Usually only if the policy has “accidental damage” cover for portable devices or an “away from home” extension. Basic contents cover often does not include it. Check the terms and the excess, which may be close to the cost of a screen.
Is phone insurance from the mobile operator real insurance or just a service?
It may be real insurance from an insurer or just a service or promise by the provider. The difference matters for where you complain. Ask in writing for the name of the company that issues it and the full terms; the Financial Ombudsman examines complaints against insurers supervised by the Superintendent of Insurance.
Can I cancel a gadget insurance I bought in the shop and get a refund?
Many such policies have a cancellation clause, and some give a period to change your mind with a refund. We found no single rule for all of them. Ask in writing for cancellation and a refund for the period you will not use, and keep proof of the date.
My laptop was stolen from a café. Which insurance, if any, pays?
Possibly contents insurance, if it has an extension for portable devices away from home, or a gadget policy. Many policies exclude devices left “unattended” in a public place, and the definition matters. Report the theft to the police, get a reference number and tell the insurer in writing.
Does the legal guarantee require the shop to repair or replace for free?
Yes. According to a law firm’s summary of Law 154(I)/2021, repair or replacement is free for you and must be done within 25 days at most in Cyprus. If it is not, you are owed a price reduction or termination with a refund.
How long can the shop keep my phone for repair under guarantee?
According to the summary of Law 154(I)/2021, 25 days at most for a repair or replacement in Cyprus. Note the date you handed in the device and ask for a written receipt.
Does phone insurance cover loss, or only theft and damage?
It depends on the policy: many phone policies cover theft and accidental damage, and loss only as extra cover or not at all. Read the definitions of “loss” and “theft” and the conditions, such as reporting to the police quickly.
Is a warranty on a used car from a dealer the same as insurance?
Not necessarily. A dealer warranty is usually the dealer’s own promise on its own terms, unless it says it is insurance from an insurer. It does not take away the rights the law gives you against the seller. Ask in writing who stands behind it and what it excludes.
Who do I complain to if a gadget insurer refuses my claim?
First a written complaint to the company that issues the cover, within 6 months of learning of the problem. If it is an insurer supervised by the Superintendent of Insurance, then the Financial Ombudsman (a €20 fee). If it is not insurance but a shop’s promise, the Consumer Protection Service.
Are expensive bikes or e-scooters covered under contents insurance?
Often only up to a per-item limit, and sometimes only inside the home. Expensive bikes or scooters may need to be declared separately. Check the per-item limit and the conditions for theft away from home, such as locking.
I bought online from another EU country. Does the 2-year guarantee still apply?
Directive (EU) 2019/771 sets a legal guarantee of at least two years across the EU, against the seller. Which law applies to a purchase from another country, and how you enforce it, can depend on the seller. For cross-border purchases within the EU, the European Consumer Centres network helps.
Does an extended warranty cover accidental damage, or only breakdowns?
It depends: some extensions cover only breakdowns, like the legal guarantee but for longer, others add accidental damage. Read whether it says “mechanical or electrical breakdown” or “accidental damage”, and the exclusions.
Is a home appliance service contract (boiler, AC) worth it?
A service contract usually gives visits and repairs on conditions, not insurance for every fault. It is worth it if its cost is reasonable compared with the repairs you would make anyway. Check what it excludes (parts, old appliances) and how it is cancelled.
If my phone was bought on instalments, does the operator’s insurance pay off the balance if stolen?
Usually not automatically: the insurance, if it pays, covers the device on its terms, while the instalment balance is a separate contract. Ask the provider in writing what happens to the instalments after a theft, before you need it.
What proof do gadget insurers usually ask for after a theft?
Usually a police reference number, proof of purchase, the IMEI or serial number, and proof that you blocked the device or the SIM. Some ask for the theft to be reported within a few hours or days. Check the deadline in your policy.
The shop sent my phone to the manufacturer and says I must wait two months. Is that allowed?
According to the summary of Law 154(I)/2021, repair or replacement must be done within 25 days at most in Cyprus; two months is far longer. Ask the seller in writing to keep to the deadline or give you a price reduction or refund. The responsibility is the seller’s, not the manufacturer’s.
Do I need receipts to use the legal guarantee, or is a card statement enough?
You need proof that you bought from this seller and when. A receipt is safest; a card transaction showing the shop’s name and the date often helps. We found no Cyprus rule listing which proof is accepted, so keep whatever you have.
Is a hearing aid or glasses covered if lost or broken?
Usually only if the contents policy has cover for personal items away from home or accidental damage, or if there is a separate policy. Hearing aids and glasses may have a per-item limit. Check the terms and keep the proof of purchase.
What you can do from today
- Keep proofs of purchase in one folder or photographed, with the delivery date.
- For each expensive device, note when the two years of the legal guarantee end.
- If it breaks: written notice to the seller within two months, with a receipt for the device.
- Before an extension or insurance: ask in writing who issues it, what it adds and the exclusions.
- Once a year, check card statements and bills for cover you do not need.
Where to turn
- A defect, a repair, a refund: first the seller in writing, then the Consumer Protection Service.
- A purchase from another EU country: the European Consumer Centres network.
- An insurer’s refusal for a device: a written complaint to the insurer, then the Financial Ombudsman.
- If you do not know whether it is insurance: the register of the Insurance Companies Control Service shows the licensed companies.
General information, not advice (legal or insurance). We give every rule with its source, and where we found no Cyprus rule we say so. Every policy has its own terms; for your own case, the law, your own policy and the insurer’s written answer apply, and for a legal dispute a lawyer’s opinion. AVRASTRO is not an insurer, does not sell general insurance and does not handle claims or complaints.
