Tax and the law: what really applies to my policies, and who protects me?
What applies to tax deductions in 2026 (including the 1/5 and 7% limits), what is still open (and we say so), and which laws and bodies protect anyone who buys insurance in Cyprus.

In short
From 2026, incapacity insurance premiums are deductible as well as life premiums, and the 7% and 1/5 rules still apply. The law also protects you before you sign: information, action in your best interests, transparency about pay.
- Collect the year’s premium certificates for your tax return.
- Before cancelling a life policy in the early years or making a partial surrender, ask what it will mean for your tax.
- On a new individual life policy you have 30 calendar days to cancel, with exceptions; note when they start.
- Keep the information document and the suitability statement with the policy.
From the series “The questions you are afraid to ask”: questions real people ask, with honest answers.
At a glance
- From 2026 incapacity insurance premiums are also deductible; contributions to approved pension schemes up to 10% of total income.
- The 7% and 1/5 rules still apply in 2026: life premiums are deductible up to 7% of the sum insured, and all related deductions together up to 1/5 of taxable income.
- Cyprus law and the EU IDD require information before you sign, action in your best interests and transparency about pay.
- On an individual life policy Cyprus law gives 30 calendar days to cancel (Article 228 of Law 38(I)/2016), with exceptions, such as policies that secure a loan.
“The laws are for the companies”
Tax is confusing, laws are written in a language nobody speaks, and after a bad experience it is easy to believe everything is set up in the companies’ favour. Here you will find what applies, as simply as possible, with sources. And, just as important, what is still open, so you do not rely on anything uncertain.
Tax: what changed from 2026
According to KPMG’s summary of the tax reform, which applies to tax years from 1 January 2026 (EY confirms this too):
- The deduction now also covers incapacity insurance premiums (permanent or partial), together with life insurance premiums.
- Contributions to approved pension or provident funds and premiums on approved pension or annuity policies: up to 10% of total income (including business profits).
- Partial surrenders: if one exceeds the policy’s gross surrender value from four years earlier, 50% of the excess is added to taxable income.
- Premiums up to €500 for insuring a home against natural disasters are deductible.
- The new family-based allowances (per child, housing, green investments) have family income caps and are not insurance allowances.
The two familiar limits still apply in 2026 (Income Tax Law, Article 14; confirmed by Grant Thornton, January 2026, and PwC, August 2026): life and incapacity premiums are deductible up to 7% of the sum insured, and all the related deductions together (life premiums, Social Insurance, GESY, provident and pension funds up to 10%, approved medical care schemes up to 2% of total income) up to 1/5 of taxable income. The new family allowances sit outside the 1/5 limit. If you cancel a life policy early, part of the relief is clawed back: on a full surrender within the first 3 years, 30% of the premiums on which you received relief is added to your income; in years 4 to 6, 20%. Your insurer issues a yearly certificate of the premiums you paid. For your own case, ask the Tax Department or a tax advisor.
The law that protects you before you sign
Insurance in Cyprus is governed by the Laws on Insurance and Reinsurance Services and Other Related Issues of 2016 to 2021, which also carry the EU Insurance Distribution Directive (IDD). According to the ICCS, the law provides for pre-contract information (Articles 223–249), the product information document (394ST(8)), a suitability or appropriateness assessment (394IZ(6)) and complaints handling (394IH). The IDD requires action in your best interests, your needs to be established and disclosure of the type of pay.
For individual life policies, Cyprus law (Article 228 of Law 38(I)/2016) gives 30 calendar days to cancel by written notice, counted from when you are told the contract has been concluded. The insurer refunds the money within one month at the latest, less medical costs it incurred for the policy. If it did not give you the written notice of this right, the period becomes two years. The right does not apply to policies of six months or less, when the policyholder is a company, or to policies taken out to secure a loan.
If a life insurer fails, the law gives policyholders priority over all of its assets (Article 327), life policies continue with the aim of transferring them to another insurer (Article 324), and since 26 April 2024 there has been a Life Insurance Guarantee Fund (Article 324A) for when a transfer is not possible. The Fund’s payment limits are set separately; ask the Superintendent of Insurance which limits apply.
Your questions, one by one
Can I deduct life insurance premiums from my taxes in Cyprus?
Yes. Life premiums, and from 2026 incapacity insurance premiums too, are deductible up to 7% of the sum insured, and all related deductions together up to 1/5 of taxable income. Both limits apply in 2026 (Income Tax Law, Article 14; Grant Thornton, PwC). For your own case, ask the Tax Department or a tax advisor.
What changed for insurance in the 2026 Cyprus tax reform?
According to KPMG: a deduction for incapacity premiums too; approved pension and annuity plans up to 10% of total income; tax on 50% of the excess in partial surrenders above the surrender value of four years earlier; a deduction of up to €500 for home insurance against natural disasters. They apply from tax year 2026.
Are health insurance premiums tax-deductible?
Contributions to approved medical care schemes are deductible up to 2% of total income, and GESY contributions are deductible too, within the overall 1/5 limit (Article 14, as it stands in 2026). Whether a particular private health plan counts as approved, ask the insurer for its premium certificate and check with the Tax Department or a tax advisor.
Is the death payout taxable for my family?
Cyprus has had no inheritance tax (estate duty) since 1 January 2000. The Income Tax Law expressly exempts lump-sum compensation on death and lump sums from provident funds; it does not name life insurance payouts expressly, so confirm your own case with a tax advisor or the Tax Department. The executor still files a statement of the estate within six months of the death.
Which law governs insurance in Cyprus?
The Laws on Insurance and Reinsurance Services and Other Related Issues of 2016 to 2021, which also carry the EU IDD, as listed by the ICCS. The Superintendent of Insurance supervises how insurers behave; disputes about the meaning of a policy are decided by the courts.
What is the Insurance Distribution Directive and how does it protect me?
It requires anyone selling insurance to act honestly and in your best interests (Article 17), to tell you what kind of pay they receive and whether they are tied to insurers (Article 19), to establish your needs (Article 20) and, for investment products, to assess suitability in writing and show the total costs (Articles 29 and 30).
Is there tax on partial withdrawals from savings policies?
From 2026 (KPMG): if a partial surrender exceeds the policy’s gross surrender value from four years earlier, 50% of the excess is added to taxable income. On a full surrender within the first 3 years, 30% of the premiums on which you received relief is added to your income; in years 4 to 6, 20% (Article 14). Ask a tax advisor before you withdraw.
Is home insurance against natural disasters deductible now?
Yes: from 2026, premiums up to €500 for insuring a home against natural disasters are deductible (KPMG). Check the conditions with the Tax Department.
Does the 7%-of-sum-insured rule still apply to life premiums?
Yes. Article 14 of the Income Tax Law, as it stands in 2026, keeps the limit of 7% of the sum payable on death or incapacity, and the overall 1/5 limit; Grant Thornton (January 2026) and PwC (August 2026) confirm it. For your own case, ask the Tax Department or a tax advisor.
Can insurance help me reduce my tax legally?
Some premiums and contributions are deductible within limits, so yes, they can reduce taxable income. But buy cover because you need it, not just for the deduction: the relief is a part of what you pay, not a gain.
Is incapacity/disability insurance deductible now?
Yes, from tax year 2026 the deduction also covers incapacity insurance premiums, permanent or partial (KPMG). They share the 7%-of-sum-insured limit with life premiums, within the overall 1/5 limit. For your own case, ask the Tax Department or a tax advisor.
What is the cap for deductible pension and provident contributions?
According to KPMG, from 2026 up to 10% of total income, including business profits, for contributions to approved pension or provident funds and premiums on approved pension or annuity policies. Confirm the details with the Tax Department.
Does Cyprus law require insurers to give me information before I sign?
Yes. The law provides for pre-contract information (Articles 223–249) and the product information document; for investment products you receive the Key Information Document in good time and a written suitability statement when advice is given. If you did not receive them, ask for them before you sign.
The laws protect the insurers, not the people.
We understand the feeling, especially after a refusal. But there are real protections: a duty to act in your best interests, transparency about pay, information before you sign, a reply to a complaint within 45 days, and Financial Ombudsman decisions of up to €20,000 that are binding, with fines for non-compliance under Law 87(I)/2026. They do not guarantee an outcome, but they give you a route.
Is there a legal cooling-off period for life insurance in Cyprus?
Yes. On an individual life policy, the law (Article 228 of Law 38(I)/2016) gives 30 calendar days from when you are told the contract has been concluded; two years if the insurer did not give you the written notice of this right. It does not apply to policies of six months or less, when the policyholder is a company, or to policies that secure a loan. Send the notice in writing and keep proof.
Do I pay tax on my policy’s maturity value?
The law does not expressly address the amount paid at maturity. It exempts capital sums from payments that received tax relief, but it does not name life insurance. Ask a tax advisor or the Tax Department before maturity, so you know what you will receive net.
Where can I read the official rules myself?
On the Tax Department’s official website for tax, the ICCS website (Ministry of Finance) for supervision and complaints, the Financial Ombudsman’s website, and the texts of EU law. Summaries by large audit firms are useful, but they are not official. Our sources are at the end of this article.
Do the new family allowances relate to insurance at all?
No. The new family-based allowances (per child, housing, green investments) have family income caps and are not insurance deductions (KPMG).
What you can do from today
- Gather the year’s premium certificates for your tax return.
- Before cancelling a life policy in its first 6 years, ask how much of the relief would be clawed back (30% or 20% of the premiums).
- Before a partial surrender, ask what tax it will carry.
- On every new individual life policy, note when you were told it was concluded: the 30 days to cancel count from then.
- Keep the information document and the suitability statement with the policy.
General information, not advice (legal, tax or insurance). Rules change; for your own case the law, your policy terms and what the competent authority confirms to you in writing apply. AVRASTRO is not an insurer.
