My claim was refused or I was treated unfairly: is there any point in complaining?

A written complaint to the insurer, a reply within 45 days, the Financial Ombudsman for €20, the Superintendent of Insurance, the courts. Who does what, the deadlines you must not miss, and what changed with Law 87(I)/2026.

In short

Yes, there is a clear path, cheap and in writing: first a complaint to the insurer, then the Financial Ombudsman. No one can promise you will win; that depends on the terms and the evidence.

  • Ask in writing for the reason and the exact policy term it relies on.
  • Send a written complaint to the insurer’s complaints officer and keep proof; it must reply within 45 days.
  • Write a timeline with dates and mark the deadlines, so you do not miss them.
  • Put all the documents in one folder, ready for the Ombudsman.

From the series “The questions you are afraid to ask”: questions real people ask, with honest answers.

At a glance

  • First a written complaint to the insurer; it must reply within 45 days.
  • The Financial Ombudsman handles disputes up to €250,000 for a €20 fee; awards up to €20,000 bind both sides.
  • Do not miss the deadlines: 6 months for the written complaint from when you learnt of the problem, then 12 and 18 months for the Ombudsman.
  • The Superintendent of Insurance supervises, but cannot order compensation or interpret policy terms.

Anger, powerlessness and a reasonable question

When a claim is refused, especially at a hard moment, the feeling is often anger and powerlessness: “the big companies always win”. We cannot promise you will be proved right; that depends on the terms and the evidence. But we can show you there is a clear route, inexpensive and in writing, and who does what at each step.

The route, step by step

  1. Ask for the reason in writing. With the exact policy clause the decision relies on.
  2. A written complaint to the insurer. Every insurer has a person responsible for complaints. It must reply within 45 days.
  3. The Financial Ombudsman. If there is no reply, or the reply is vague or unsupported. A €20 fee, a written procedure, in Greek or English.
  4. The Superintendent of Insurance, or the courts. The Superintendent reviews the complaint as supervisor; a court decides the dispute and interprets the contract.

The Financial Ombudsman in plain words

  • It handles complaints about life, health, home, car, travel and other insurance, against insurers supervised by the Superintendent of Insurance.
  • For consumers and small companies with turnover up to €350,000.
  • Disputes up to €250,000; awards up to €100,000.
  • Awards up to €20,000 bind both sides; above €20,000, only if both accept them in writing within two months.
  • Usually a decision within 90 days of having all the documents; complex cases can take longer.
  • If the firm loses, it pays a fixed €350 fee (according to the EU consumer-redress listing).

Since 1 June 2026, under Law 87(I)/2026 (as described in a legal analysis on Mondaq), a party may appeal a binding decision to the District Court within 30 days; otherwise the decision must be carried out within 30 days of the appeal deadline. The Ombudsman can fine a firm that does not comply and seek a court compliance order.

Your questions, one by one

My claim was refused. What can I do?

First ask for the reason in writing, with the exact policy clause. Then make a written complaint to the insurer, which must reply within 45 days. If it does not reply, or the reply is vague or unsupported, you can go to the Financial Ombudsman, ask the Superintendent of Insurance for a supervisory review, or go to court.

How do I complain to an insurance company in Cyprus?

In writing, to the insurer’s person responsible for complaints (every insurer has one). Say what happened and what you are asking for, and attach the documents. Keep a copy and proof of the date you sent it.

How long does the insurer have to answer my complaint?

45 days, according to the ICCS. If it does not reply, or the reply is vague or unsupported, you can move on to the next step.

What is the Financial Ombudsman and can it help with insurance?

It is an out-of-court body for disputes with financial firms, and it also handles complaints about life, health, home, car and travel insurance against insurers supervised by the Superintendent of Insurance. It is for consumers and small companies with turnover up to €350,000.

How much does it cost to complain to the Financial Ombudsman?

€20 when you submit the complaint (the Ombudsman’s FAQ), paid online or by bank transfer in your own name; it is not refunded if the complaint is rejected or withdrawn. According to the EU consumer-redress listing, the firm pays a fixed €350 if the decision goes against it.

Are the Ombudsman’s decisions binding on the insurer?

Awards up to €20,000 bind both sides; above that, only if both accept them in writing within two months. Under Law 87(I)/2026 (in force since 1 June 2026), a party may appeal a binding decision to the District Court within 30 days; otherwise it must be carried out within 30 days of the appeal deadline.

Is there a deadline to complain?

Yes: a written complaint to the firm within 6 months of becoming aware of the problem; then to the Ombudsman within 12 months of that written complaint and within 18 months of becoming aware. Do not wait.

Can the Superintendent of Insurance force the insurer to pay me?

No. The Superintendent supervises insurers and reviews complaints as a supervisory authority, but cannot order compensation, set an amount or interpret policy terms; that belongs to the courts (or the Ombudsman, for disputes within its scope).

How long does an Ombudsman case take?

Usually within 90 days of the Ombudsman having all the documents it needs; complex cases can take longer. A complete file from the start helps.

Complaining is pointless; the big companies always win.

We understand the feeling. We have no figures on how often consumers win, so we promise nothing. But the procedure is inexpensive (€20) and in writing, awards up to €20,000 are binding, and a firm that does not comply can be fined. In a written procedure, a clear, well-documented complaint carries weight.

Can I complain in English or Russian?

According to the EU consumer-redress listing, complaints to the Financial Ombudsman are submitted in Greek or English. Russian is not listed, so prepare the complaint in English or Greek; a translation of the key documents helps.

Do I need a lawyer to go to the Ombudsman?

The procedure is written, designed for consumers, with a €20 fee; our sources do not mention any need for a lawyer. For a complex or large case you may still want legal advice.

Can my family complain on my behalf after my death?

Beneficiaries often have their own claim against the insurer. Whether they can complain to the Ombudsman in their own name or through the estate’s administrator, ask the Ombudsman’s office before filing, and watch the deadlines.

What documents should I prepare for a complaint?

The policy and its terms, your claim, the written reason for the refusal, all correspondence and a short timeline of events. Add any medical or other reports the decision relied on.

What if my dispute is larger than €250,000?

The Ombudsman handles disputes up to €250,000 and awards up to €100,000. For larger disputes the route is usually the courts; take legal advice.

It’s reassuring to know there’s an independent body. How do I reach it?

The Financial Ombudsman of the Republic of Cyprus has its own website with the procedure and forms; the complaint is made in writing, in Greek or English, with a €20 fee. First, though, complain in writing to the insurer and give it a reasonable time to reply.

Can I complain about the advisor rather than the insurer?

Yes. Start with a written complaint to the advisor or their firm. Intermediaries are entered in the ICCS register, and you can also contact the ICCS about their conduct.

What happens if the insurer ignores an Ombudsman decision?

Under Law 87(I)/2026, the Ombudsman can fine a firm that does not comply and ask the court for a compliance order.

I complained and the insurer just repeated their refusal. Now what?

This is the moment to move on. Check the dates (6, 12 and 18 months), gather the documents and submit the complaint to the Financial Ombudsman with the €20 fee. You can also inform the Superintendent of Insurance.

Is mis-selling a valid reason to complain years later?

Possibly. The deadlines run from when you became aware of the problem, not from signing: a written complaint within 6 months of that, and the Ombudsman within 12 months of the complaint and 18 months of becoming aware. The suitability statement and the pre-contract documents are key evidence.

What is the difference between the Superintendent and the Ombudsman?

The Superintendent of Insurance supervises insurers (how they behave, how they handle complaints) but does not decide individual compensation. The Financial Ombudsman decides individual disputes out of court, with binding awards up to €20,000. The courts decide any dispute and interpret contracts.

What you can do from today

  • Ask in writing for the reason and the policy clause.
  • Send a written complaint to the complaints officer and keep proof.
  • Mark the 45 days and the 6, 12 and 18-month deadlines in your calendar.
