In short

There is a written route before court: first a written complaint to the insurer, then the Financial Ombudsman, who also handles car, home and travel complaints. No one can promise you will win; that depends on the terms and the evidence.

  • Ask in writing for the reason for the refusal and the exact clause.
  • Send a written complaint to the complaints officer within 6 months, and keep proof of the date.
  • Note the deadlines in your diary, and after a road accident the date 3 years on.
  • Put all the documents in one folder, ready for the Ombudsman, in Greek or English.

From the series “The questions you are afraid to ask”, part “General insurance”: questions real people ask, with honest answers. Information only.

At a glance

  • First a written complaint to the insurer, within 6 months of learning of the problem; the Superintendent’s guide says a reply within 45 days.
  • For a refusal to renew, a termination or a price rise in motor insurance, the law gives the insurer 15 working days to reply to your written complaint.
  • The Financial Ombudsman examines complaints about car, home and travel insurance: a €20 fee, disputes up to €250,000, decisions up to €20,000 binding.
  • The Superintendent of Insurance supervises insurers, but cannot order payment or interpret terms.
  • Courts: 6 years for contract claims, 3 years after a road accident, and negotiating does not stop the clock.

“They are stronger than me”

A refusal for a car, a home that flooded, a trip that went wrong. The first feeling is often anger and powerlessness. We cannot promise you will be proved right; that depends on the terms and the evidence. But we can show you there is a clear route, inexpensive and in writing, and who does what at each step. This article focuses on general insurance; the full picture for every kind of insurance is in My claim was refused: is there any point in complaining?, and the letter templates in How to build your case.

The steps, in order

  1. Ask for the reason in writing. With the exact policy clause and the evidence (reports, assessments) the decision relied on.
  2. A written complaint to the insurer. Within 6 months of learning of the problem, to the complaints officer. The Superintendent’s guide says a reply within 45 days. For a motor refusal to renew, a termination or a premium rise, the law sets 15 working days.
  3. The Financial Ombudsman. If there is no reply or it is vague. A €20 fee, in writing, in Greek or English, within 12 months of the written complaint and 18 months of learning of the problem. Claims against insurers up to €20,000 are examined by the Deputy Ombudsman.
  4. The Superintendent of Insurance, for conduct. For a reply that never came or a misleading statement. It does not decide compensation.
  5. The courts. Always open, usually slower and more costly, with a lawyer. If you go to court, the Ombudsman’s examination stops.

The deadlines in one table

StepDeadline
Written complaint to the insurer6 months from learning of the problem
The insurer’s replyUp to 45 days according to the Superintendent’s guide; 15 working days for a motor refusal to renew, termination or price rise (Law 96(I)/2000, Art. 3C)
Going to the Ombudsman12 months from the written complaint and 18 months from learning of the dispute
The Ombudsman’s decisionUsually within 90 days of a complete file
Appeal against a binding decision30 days to the District Court; otherwise carried out within 30 days of the appeal deadline
Suing an insurer (contract)6 years (Law 66(I)/2012)
Suing after a road accident3 years from the accident; negotiating does not stop the clock (according to a law firm)

What we could not confirm

  • Whether heirs can complain to the Ombudsman about a claim of a relative who died.
  • Whether compensation can be awarded for stress and inconvenience; the sources speak of actual financial damage.
  • A legal deadline for paying a claim that was accepted.
  • Whether a complaint to the Ombudsman stops the clock for going to court.

What went wrong for others — and how to avoid it

  • The 6-month window for the written complaint was missed (Cyprus). As soon as a claim is refused or delayed, send a short written complaint; you can add details later.
  • Some expected the Superintendent of Insurance to order payment (Cyprus). For money owed to you, the Ombudsman or the courts; write to the Superintendent about conduct, such as a reply that never came.
  • Suing and complaining to the Ombudsman at the same time (Cyprus). If you sue, you must tell the Ombudsman the same day and the examination stops. Choose your route on purpose.
  • Under the old regime (2015–2023), insurers did not accept 79% of the decisions that required acceptance (Cyprus). That has changed: today decisions up to €20,000 are binding, and Law 87(I)/2026 added fines. Complain with documents.

Your questions, one by one

My home claim was refused. What are my steps before going to court?

Ask in writing for the reason and the clause. Make a written complaint to the insurer within 6 months; the Superintendent’s guide says a reply within 45 days. If there is no reply or it is vague, go to the Financial Ombudsman (€20) or inform the Superintendent of Insurance; the courts always remain open.

Does the Financial Ombudsman deal with car, home and travel insurance complaints?

Yes. It examines complaints about home, car and travel insurance, among others, against insurers supervised by the Superintendent of Insurance. It is for consumers and small companies with turnover up to €350,000, with a €20 fee.

For a motor renewal refusal or price rise, how long does the insurer have to answer my complaint?

Under Article 3C of the motor insurance law, as amended in 2026, you first make a written complaint to the insurer. If it does not reply within 15 working days, or the reply does not satisfy you, you can go to the Financial Ombudsman and complain to the Superintendent of Insurance.

Is the Insurance Companies Control Service able to force the insurer to pay me?

No. The Superintendent of Insurance supervises insurers and how they handle complaints, but cannot order compensation, set an amount or interpret terms; those belong to the courts and the Financial Ombudsman. In motor insurance it can now fine breaches of the rules on age and written reasons.

What is the time limit for complaining to the Ombudsman after a refusal?

First a written complaint to the insurer within 6 months of learning of the problem. Then to the Ombudsman within 12 months of the written complaint and within 18 months of learning of it. Do not wait.

The insurer never replied to my written complaint. What now?

This is the moment to move on. Check the dates (6, 12 and 18 months), gather the documents with proof of the date you sent them, and submit a complaint to the Financial Ombudsman with the €20 fee. You can also inform the Superintendent of Insurance about the missing reply.

Should I go to the Ombudsman or straight to a lawyer?

The Ombudsman costs €20, is in writing and designed for consumers, for disputes up to €250,000 and awards up to €100,000. The courts have no such limits but are usually slower and more costly. If you go to court, the Ombudsman’s examination stops, so choose deliberately, and for a large amount get legal advice.

What should my first written complaint to the insurer include?

What happened, with dates; the policy and claim numbers; exactly what you are asking for; why you disagree with the clause or the assessment; and the documents (policy, written refusal, reports, photos, correspondence). Send it to the complaints officer by email or registered post and keep proof of the date. You will find templates in How to build your case.

The insurer refused my claim with one line and no reason. Do they have to explain?

Ask in writing for the specific clause and the evidence for the decision. The Insurance Companies Control Service treats a vague or unsupported reply as a reason to move on to the Ombudsman or the Superintendent. For a motor refusal to renew or a price rise, the law expressly requires adequate, documented reasons in writing.

Is the exclusion still valid if it was hidden in the small print and nobody explained it?

Not automatically invalid. In two Court of Appeal decisions (Civil Appeals 411/2019 and 10/2018), unclear exclusions were read in favour of the insured, but only because more than one reasonable reading existed. If your clause can be read two ways, say so in your complaint, together with what you were told when you bought.

Can I complain about an insurer based in another EU country that sells in Cyprus?

The Ombudsman examines complaints against insurers supervised by the Superintendent of Insurance. For a company based in another EU country, ask the Ombudsman first whether it can examine it; if not, the equivalent body in its home country may be competent, and the EU’s FIN-NET network shows you which. Always start with a written complaint to the company itself.

Does complaining to the Ombudsman stop the clock for going to court?

We found no rule saying that it does, so do not assume it. The court deadlines are 6 years for contract claims, and 3 years after a road accident, where negotiating does not stop the clock. For a case close to the deadline, get legal advice in good time.

Can I ask for compensation for stress and wasted time, not just the money?

The Ombudsman’s sources speak of compensation for actual financial damage, up to €100,000. We found no source saying that awards for stress and inconvenience are made, so we do not promise it. The Ombudsman may recommend an additional voluntary payment, which the firm does not have to make.

Where can I find out if an insurer or agent is properly licensed in Cyprus?

The Insurance Companies Control Service keeps registers of licensed insurers and registered intermediaries. For how to check them, see how to check a registration and where to complain. A company from another EU country may be supervised by its home country; ask the Service.

I feel the insurer is stronger than me. Are small claims worth fighting?

We understand the feeling. The route is inexpensive (€20) and written, decisions up to €20,000 are binding, and a firm that does not comply can be fined. In the EU, 16% of people who claimed believed their claim was wrongly refused (EIOPA, not Cyprus). We have no success rates for Cyprus, so we promise no outcome.

What are the most common complaints about non-life insurance in Europe?

According to EIOPA (EU data, not Cyprus), claims handling made up 52% of non-life complaints handled by firms in 2024. 17% of those who claimed in the last two years were dissatisfied and 16% believed their claim was wrongly refused. Frequent reasons: a lower payout than expected and a long process.

My car insurer cancelled my policy mid-year without warning. What are my rights?

Under the motor insurance law (Articles 3A and 3B, 2026), age cannot be the sole reason for termination, and for an existing policyholder adequate, documented reasons in writing are required. Ask in writing for the reason and the policy’s cancellation clause, and make a written complaint; if there is no reply in 15 working days, the Ombudsman and the Superintendent. Meanwhile do not drive uninsured: it is a criminal offence.

If the Ombudsman awards me money, how quickly must the insurer pay?

Under Law 87(I)/2026 (in force since 1 June 2026, as a legal analysis describes it), a binding decision up to €20,000 can be appealed to the District Court within 30 days; otherwise it must be carried out within 30 days of the appeal deadline. Above €20,000, it binds only if both accept it in writing within two months. The Ombudsman can fine a firm that does not comply.

Can heirs complain to the Ombudsman about a home or car claim of a relative who died?

We did not find it stated on the Ombudsman’s pages. A representative, such as a relative, needs a special power of attorney. Ask the Ombudsman’s office (22848900) before filing, and watch the deadlines.

The insurer won’t renew my car policy and gave no written reason. Can I keep driving while I complain?

Not without insurance: driving an uninsured vehicle carries up to 1 year in prison and/or a fine of up to €3,000 and disqualification, and we found no rule that cover continues while the complaint is pending. The law requires written reasons at least three months before expiry; make a written complaint (a reply within 15 working days), and meanwhile find cover elsewhere.

Is going to court against an insurer very expensive in Cyprus?

The cost depends on the case and the lawyer; we give no figures for Cyprus. The Ombudsman costs €20 and, according to our sources, needs no lawyer, for disputes up to €250,000. If the firm loses, it pays a fixed €350 fee (according to the EU consumer-redress listing).

Where to turn

  • First: the insurer’s complaints officer, in writing.
  • A dispute over money: the Financial Ombudsman of the Republic (22848900), with a €20 fee.
  • The company’s conduct: the Superintendent of Insurance (Insurance Companies Control Service, Ministry of Finance).
  • A company from another EU country: the EU’s FIN-NET network shows the competent body.
  • A legal dispute: a lawyer and the courts.

General information, not advice (legal or insurance). We give every rule with its source, and where we found no Cyprus rule we say so. Every policy has its own terms; for your own case, the law, your own policy and the insurer’s written answer apply, and for a legal dispute a lawyer’s opinion. AVRASTRO is not an insurer, does not sell general insurance and does not handle claims or complaints.
