Hit by an uninsured driver, or by one who drove off: will I ever be paid, and by whom?

What the Motor Insurers’ Fund does when the driver at fault has no insurance, what to do within 48 hours after a hit-and-run, why you should not repair before telling the Fund, the documents, car theft, foreign cars, and what we could not confirm.

In short

If the driver at fault has no insurance, the Motor Insurers’ Fund compensates the victims and then pursues the driver. After a hit-and-run, go to the police quickly and tell the Fund before any repair; whether it also pays for damage to your car when the driver is never found, we could not confirm.

  • After a hit-and-run: the police within 48 hours, a case number, photos.
  • Do not repair before telling the Motor Insurers’ Fund in writing.
  • Keep the police report, registration, insurance certificate and medical reports in one folder.
  • Note the date 3 years after the accident: negotiating does not stop the clock.

From the series “The questions you are afraid to ask”, part “Car, home, travel”: questions real people ask, with honest answers. Information only.

At a glance

  • If the driver at fault has no insurance, the Motor Insurers’ Fund compensates the victims and then pursues the driver for the full amount.
  • After a hit-and-run: the police immediately, within 48 hours at the latest, and tell the Fund before any repair.
  • In 2025 the Fund received 1,725 claims, and from 2021 to the end of 2025 it paid more than €19.2m.
  • Whether the Fund also pays for damage to your car when the driver is never found, we could not confirm; ask it in writing.
  • A claim for a road accident must be brought to court within 3 years of the accident, and negotiating does not stop the clock.

The anger, and the question “who will pay?”

You find your car dented in the car park and no note. Or the other driver tells you, with a shrug, that he “has no insurance”. It is natural to feel angry and wronged, and to fear that you will pay for something you did not do. There is a body for exactly these cases, with rules and deadlines. Here is what we found, with its sources, and what we could not confirm.

What the law already gives you

  • Every vehicle on the road must have at least third-party cover (Law 96(I)/2000). Driving uninsured is punishable by up to 1 year in prison and/or a fine of up to €3,000 and disqualification from driving; on a second conviction within two years, up to 2 years and €6,000. The fixed penalty is €200 and 3 to 6 penalty points (Politis, July 2026).
  • The Motor Insurers’ Fund compensates victims when the driver at fault has no insurance, and then claims the full amount back from that driver. Its members are the insurers that write motor cover in Cyprus.
  • If a motor insurer becomes insolvent, Law 167(I)/2023 (Directive 2021/2118) gave the Fund a role for the victims, and for cooperation with the matching funds of other Member States.
  • The Fund is not a guarantee fund for life or savings policies. It is for road accidents only; see what happens if the insurer fails.

Source: Politis, 6 July 2026, with figures from the Fund and the Insurance Association. In total more than €19.2m from 2021 to the end of 2025. The number of uninsured vehicles is an estimate: more than 80,000 (2026 report).

After a hit-and-run or an uninsured driver: the order

  • The police immediately, within 48 hours at the latest. Ask for a case number. Even for scratches, if you mean to claim.
  • Photos and details: the place, the damage, witnesses, cameras nearby, and if you know the other driver, his registration number.
  • Tell the Fund before any repair, and your own insurer too, even if you will not claim from it.
  • A claim with the documents: the police report, the vehicle registration, your own insurance certificate, medical reports if you were injured.
  • Note the 3-year date. If no fair offer has come well before it, speak to a lawyer in good time.

What we could not confirm

We could not read the article of the law on vehicles that are never identified. That is why we do not say whether the Fund pays for property damage when the driver is never found, or whether there is an excess; the EU directive lets countries limit this. Nor did we confirm how claims involving cars with plates from the northern part of the island are handled, or whether there is a public way to check if a vehicle is insured. Ask the Fund in writing and keep the answer.

If the other driver is at fault and insured, see how to claim from their insurer. For disputes with your own insurer: A dispute over car insurance. For theft: What to do after a theft.

What went wrong for others — and how to avoid it

  • The victim negotiated for years and ran out of time (Cyprus). A claim for a road accident must go to court within 3 years of the accident, and negotiating does not stop the clock (a law firm’s article). How to avoid it: note the date from day one and speak to a lawyer well before it.
  • The insurer relied on a loosely worded exclusion (Cyprus). In two Court of Appeal decisions (Civil Appeals 411/2019 and 10/2018) the ambiguity was read in favour of the insured. How to avoid it: if a claim is refused, for example after a theft, ask in writing for the exact clause of the policy.

Your questions, one by one

An uninsured driver hit me. Will I ever get paid for my car?

Yes, there is a route. If the driver at fault was identified but has no insurance, the Motor Insurers’ Fund compensates the victims and then claims the money back from him. If you have comprehensive cover, your own insurer may pay you under its terms. Report it to the police at once and tell the Fund before the repair.

What is the Motor Insurers’ Fund and how do I claim from it?

It is the body that compensates road-accident victims when the driver at fault has no insurance, and then pursues that driver. Its members are the motor insurers. To claim you need the police report, the vehicle registration, your own insurance certificate and, if you were injured, medical reports.

Someone hit my parked car and drove off. How quickly must I report it to the police?

At once, and within 48 hours at the latest, according to the Insurance Association’s statement on claims to the Fund (Politis, July 2026). Ask for a case number and take photos before moving the car, if it is safe.

Can I repair my car before the Motor Insurers’ Fund sees it?

Better not. The guidance is to tell the Fund before any repair, so that it can see or assess the damage. If something is urgent for safety, photograph it first and ask in writing.

Does the fund pay for car damage when the hit-and-run driver is never found?

This we could not confirm, because we did not read the relevant article of the law, and the EU directive lets countries limit it. Report it to the police within 48 hours, tell the Fund before the repair and ask for a written answer. If you have comprehensive cover, ask your own insurer too.

My comprehensive insurer can pay me and then chase the uninsured driver. Does that cost me my bonus?

In Cyprus there is no common no-claims scale; each insurer sets its own system. Whether a claim for damage you did not cause affects your discount is in your own policy. Ask in writing before you claim.

The Motor Insurers’ Fund paid my claim. Will they really pursue the driver who hit me?

The Fund claims the full amount from the driver at fault. In practice it recovers a small share: 7.2% in 2023, 10.4% in 2024 and €471,465 (11.8%) in 2025. But that is between the Fund and the driver; your own compensation does not depend on whether it gets the money back.

My car was stolen. How long until the insurer pays, and what if it’s found later?

Many policies set a waiting period in case the car is found before they pay, and what happens if it is found after payment (it usually passes to the insurer, or you return the money). The time and the options are in your own policy terms. Report the theft to the police at once and ask the insurer in writing what applies.

Is my car covered if it’s stolen with the keys from my house?

Many policies cover theft with the keys only if the keys were taken in a break-in or by force, and exclude keys left in the car. Check the key conditions in your own policy. Report both the burglary and the car theft to the police.

Is a car stolen and taken to the north covered by theft insurance?

This is set by the theft terms and the territorial scope of your own policy; many policies pay for the theft wherever the car ended up, others have limits. Report the theft to the police at once and ask the insurer for a written answer.

I was a passenger in an uninsured car. Can I claim for my injuries?

The Fund compensates victims when the driver at fault has no insurance, and as a passenger you are a victim. Whether it matters that you knew the vehicle was uninsured, we did not confirm in Cyprus law. Claim with medical reports and the police report, and ask the Fund in writing.

What documents does the Motor Insurers’ Fund ask for?

According to the Insurance Association (July 2026): the police report, the vehicle registration, your own insurance certificate, and medical reports if you were injured. Keep copies and photos, and ask the Fund for the list for your own case.

The driver who hit me had a foreign-plated car. Who pays?

A car normally kept in another EU country has its own compulsory insurance, valid across the EU. Vehicles from outside the EU need a green card or a frontier insurance certificate on entry. Take the plate and insurance details, call the police, and ask your insurer and the Fund how to reach the other car’s insurer.

The car that hit me had north Cyprus plates. Will anyone compensate me?

Under the law, a vehicle entering without a recognised certificate needs frontier insurance, valid from 30 days to one year. How this applies to cars from the northern part, and how claims are handled, we did not confirm. Call the police, photograph the other driver’s insurance document and ask your insurer and the Fund in writing.

Can the fund refuse to pay me if I knew the driver was uninsured?

We could not confirm this in Cyprus law. Whatever applies, describe the facts honestly in the claim, because an inaccurate statement can harm you more. Ask the Fund for a written answer on your own case.

What happens if I’m in an accident with a government or army vehicle?

The minor-collision rule, where you move the cars after taking photos, does not apply when a vehicle belongs to a public authority; call the police. The law also provides that the Fund compensates when a vehicle exempted from the duty to insure has no insurance. Take details and tell your insurer.

Is the Motor Insurers’ Fund the same as a guarantee fund for my life or savings policy?

No. The Motor Insurers’ Fund is only for road-accident victims. Life policies have a separate framework; see what happens if the insurer fails.

Is my car’s catalytic converter or wheels stolen while parked covered?

Many policies with theft cover also pay for stolen parts, others only for the whole car, and often with an excess. Third-party-only cover does not pay for your own car. Check the theft terms and report it to the police.

Should a hit-and-run with only scratches still be reported to the police?

Yes, if you want to claim. The guidance for claims to the Fund is the police at once, within 48 hours at the latest, and a case number. A small dent often turns out more expensive at the garage.

Can I check a car’s registration to see if it is insured?

We found no public lookup we could confirm. After an accident, ask to see the other driver’s insurance certificate and photograph it; if he refuses, call the police. The Fund and your insurer can tell you what to do next.

If my motor insurer goes bust, who pays the person I injured?

Law 167(I)/2023 gave the Fund a role when a motor insurer becomes insolvent, so that victims are not left without compensation. Tell the Fund at once, and find new cover for your car with no gap.

What you can do from today

  • Save your insurer’s number and a photo of your insurance certificate on your phone.
  • After a hit-and-run: the police within 48 hours, a case number, photos.
  • Do not repair before you have told the Motor Insurers’ Fund in writing.
  • Gather the police report, registration, insurance certificate and medical reports in one folder.
  • Put the date 3 years after the accident in your calendar.
  • If you have comprehensive cover, ask in writing what happens to your no-claims bonus before you claim.

Where to turn

  • Hit-and-run, uninsured driver, theft: the Police (at once; within 48 hours at the latest after a hit-and-run).
  • Compensation when the driver at fault has no insurance: the Motor Insurers’ Fund, before any repair.
  • The 3-year limit to sue: a lawyer, in good time.
  • A dispute with an insurer: first a written complaint to the company itself, which must reply within 45 days; then the Financial Ombudsman (fee €20, disputes up to €250,000) or the courts. The Insurance Companies Control Service supervises insurers, but it does not decide private disputes or award compensation.
